Active NCAA Athletes Added to Lawsuit Over TV Money, Videogames

On Thursday, active athletes were added to a proposed class action lawsuit against the NCAA where billions of dollars in TV money could be at stake.

The lawsuit has been pending for more than four years, and has taken turns and twists on its route to becoming a legal challenge that focuses on the alleged antitrust injuries inherent in forcing athletes to sign waivers and give up the right to profit from video game and broadcasting deals.

A San Francisco federal judge is considering whether to certify the class action, and after a hearing last month, allowed the plaintiffs to amend their claims to add current athletes to the proposed lawsuit. Now joining ex-athletes like Oscar Robertson and Bill Russell are those still in school including Arizona linebacker Jake Fischer, Clemson defensive back Darius Robinson and Minnesota senior wide receiver Victor Keise.

While not as famous as the ex-athletes, the inclusion of a half dozen current athletes arguably ups the stakes as the NCAA and member conferences find that their most lucrative licensing partnerships are potentially subject to antitrust scrutiny. In addition to the new named plaintiffs as class representatives, the plaintiffs have added details in a whopping 213-page amended complaint that was filed on Thursday.

The new charges come after U.S. District Judge Claudia Wilken told the plaintiffs that the "pleading may be amended only the minimum amount necessary" to conform to their certification motion and deficiencies identified by the defendants.

Throughout the process, the NCAA and other defendants like Electronic Arts have been upset at how much the plaintiffs' claims have changed from the legal fight's start. At the beginning, the case was more about some video games that allegedly misappropriated the likeness of former players through avatars. The evolution to a lawsuit that's the biggest antitrust challenge the NCAA has ever faced has become a basis partly for the defendants' demand that the certification be denied.

As Judge Wilken examines whether to let the plaintiffs proceed -- and if so, how -- the new amended lawsuit includes allegations like EA offering to establish a player fund in 2007 for the use of student-athlete names, images and likenesses.

According to the complaint, the Collegiate Licensing Company, "negotiating on the NCAA's behalf, instead suggested that the money should go to the NCAA. EA agreed to pay a kicker to NCAA in order 'to align interests and incentivize all parties to help build the category with new rights.' EA made this offer contingent on 'no royalties ... to a player fund.'"

The plaintiffs say that not everybody was on board this plan within the NCAA's ranks.

"NCAA administrators noted 'real concern' that use of student-athletes' names, images, and likenesses in video games 'adds to the argument that student-athletes should be unionized and receive a cut of the profits, etc.," says the lawsuit.

But objections were allegedly overruled by former NCAA president Myles Brand and NCAA marketing executive Greg Shaheen.

Last week, in the midst of the legal drama, the NCAA ended its relationship with EA.

As for TV money,? the plaintiffs talk about how the NCAA has grown its annual tournament from one that derived a few million dollars in 1979 to one that now commands billions of dollars. And the plaintiffs point to ways that "new licensing deals for this game continue to be struck," for example, speaking how the "Big Ten's Greatest Games" are now shown on Hulu, co-owned by Fox, which is also a partner in the Big Ten Network.

In the demand for relief, the plaintiffs believe that they are entitled to a declaration that any releases that purport to relinquish rights to compensation are "void and unenforceable" and further that defendants and their partners "be permanently enjoined and restrained from, in any manner,?continuing, maintaining, or renewing the contract, combination, or conspiracy alleged... ."

The athletes also want the defendants to be disgorged of profits connected to the sale of videogames as well as any products that contain game footage. They haven't directly asked for money from live television events yet (notwithstanding how today's televised games often provide flashbacks), but if ultimately successful, the class action could raise questions about what kind of consent is needed from active athletes, and potentially pave the way towards some sort of deal that puts an end to amateurism in college sports.

The California church where Ronald Reagan married has announced plans to do same-sex weddings.

The former US president, whose delayed response to the HIV/AIDS outbreak in 1980s has been criticized long after his death, married his wife Nancy in the Little Brown Church in 1952.

The Little Brown Church last made news headlines in 2008 when Britney Spears was spotted with her then-boyfriend Adnan Ghalib stopping into the church to light a candle after leaving a custody hearing at the Los Angeles Supreme Court.

Based in the San Fernando Valley in Southern California, the Little Brown Church opened in 1939, and since then has hosted over 23,000 ceremonies, including several same-sex ceremonies during the period when it was legal in California.

Pastor Russel Willoughby said: ?It was an honor for me to officiate at their weddings.?

Last month, the Golden State reclaimed marriage equality when the US Supreme Court ruled Prop 8, California?s ban on gay marriage, was unconstitutional.?

Willoughby told World Entertainment News Network: ?At the Little Brown Church, we believe that loving relationships are gifts from God, regardless of the sexual orientation of those involved.

?I have a hard time understanding why the thought of two people loving each other and devoting their lives to one another is so upsetting to many Christians. So what if the people in love are not heterosexual?

Poll: US still seen as top economic power

WASHINGTON (AP) ? The United States is still viewed as the world's leading economic power in many countries, according to polls in 39 nations by the Pew Research Center's Global Attitudes Project. But as the Great Recession has buffeted the U.S. economy, China has gained rapidly in the eyes of the rest of the world, and many say it ultimately will replace America as the world's top global economic force.

In 22 of the 39 nations polled, the U.S. is seen as the top global economy, while China is viewed as having the upper hand in eight countries, including U.S. allies Canada, Britain, Germany and France. Surprisingly, Americans are about evenly divided over which country has the stronger economy, with 44 percent saying China and 39 percent the United States.

Since 2008, the population share that calls China the world's top economy has just about doubled in Spain, Germany and Britain, nearly tripled in Russia, and gained 22 points in France. Of the 20 countries Pew surveyed in both 2008 and 2013, all but two are now significantly more likely to say China is the world's leading economic power.

In 18 of the countries polled, half or more believe China has or will replace the U.S. as the world's top economic force, while majorities in only three believe the U.S. will maintain its top economic position.

The surveys, conducted before news about the NSA's surveillance programs broke, also found that 37 of the 39 countries saw the U.S. as a good steward of individual liberty than a poor one.

Before leaks of classified documents revealed widespread U.S. tracking of Internet communications among people in other countries, many said they were confident President Barack Obama would do the right thing in world affairs, including 88 percent in Germany and 83 percent in France, two allies whose official reactions to the spying program have been broadly negative. Few in those nations think the U.S. gives their countries' concerns much weight when setting foreign policy; just 35 percent in France and half in Germany say America considers their interests at least "a fair amount."

Other findings from the surveys:

? The U.S. is viewed favorably by a majority in 28 of the 38 other nations tracked in the poll, with favorability ratings above 80 percent in Ghana, Senegal and Kenya in Africa, Israel in the Middle East and the Philippines in Asia. America fares worst in the Middle East, where most have an unfavorable opinion in five of seven nations surveyed, including 81 percent with a negative view in Egypt and 70 percent unfavorable in Turkey.

? Among those in nations that receive U.S. economic aid, Egyptians and Pakistanis are more apt to say the assistance is having a negative impact on their country, while other African nations surveyed view such assistance as a positive influence.

? Majorities in just three of the 39 countries say they approve of the U.S. use of drones to target extremists: Israel (64 percent approve), the United States (61 percent approve) and Kenya (56 percent approve).

? More than 9 in 10 in Japan (96 percent) and South Korea (91 percent) say that China's growing military power is a bad thing.

The Pew Research Center interviewed 37,653 respondents in 39 countries from March 2 through May 1, 2013. Interviews were conducted face-to-face or by telephone, depending on the country, and are representative of at least 95 percent of the adult population of each nation except for China and Pakistan, where the samples were disproportionately urban, Argentina, Bolivia, Greece, Indonesia and Malaysia, where some difficult to reach or rural populations were excluded, and the Czech Republic and Japan, where interviews were conducted either by cellular or landline telephone only.

Breeding Duck Numbers Improved, Canada Goose Population Declines

Despite lingering winter weather that included record late ice-out in 2013, Minnesota?s breeding duck populations improved from last year, according to the results of the annual Department of Natural Resources? spring waterfowl surveys.

The state?s estimated breeding duck population was 683,000 compared with last year?s estimate of 469,000. This year?s estimate is 10 percent above the long-term average of 620,000 breeding ducks.

This year?s mallard breeding population was estimated at 293,000, 30 percent above last year?s estimate of 225,000 breeding mallards, 14 percent above the recent 10-year average and 30 percent above the long-term average.

The blue-winged teal population was 144,000 compared with 109,000 in 2012 but remained 33 percent below the long-term average of 216,000.

The combined populations of other ducks, such as wood ducks, ring-necked ducks, gadwalls, northern shovelers, canvasbacks and redheads was 246,000, This was 82 percent higher than last year and 39 percent above the long-term average.

The estimated number of wetlands (Types II-V) was 258,000, up 13 percent from last year, and 2 percent above the long-term average. ?Although wetland numbers were average, conditions changed from extremely dry before May 1 to fairly wet by the end of May in most of the state,? said Steve Cordts, DNR waterfowl specialist.

?Also, in a normal year, ducks begin arriving back to Minnesota in April or early May to begin the nesting season,? Cordts said. ?But with record late ice-out and significant snow cover present in some areas until early May, the spring migration and nesting season were delayed so we had to delay the survey about two weeks.?

The DNR?s waterfowl survey has been conducted each year since 1968 to provide an annual index of breeding duck abundance. The survey covers 40 percent of the state that includes much of the best remaining duck breeding habitat in Minnesota. A DNR waterfowl biologist and pilot count all waterfowl and wetlands along established survey routes by flying low-level aerial surveys from a fixed-wing plane. The survey is timed to begin in early May to coincide with peak nesting activity of mallards. The U. S. Fish and Wildlife Service provide ground crews that also count waterfowl along some of the same survey routes. This data is then used to correct for birds not seen by the aerial crew.

This year?s Canada goose population was estimated at 250,000, which was considerably less than last year?s estimate of 416,000. The number of breeding Canada geese in the state is estimated via a helicopter survey of nesting Canada geese in April. The survey, which includes most of the state except for the Twin Cities metropolitan area, counts Canada geese on randomly selected plots located in prairie, transition and forested areas.

Although this year?s estimate was lower than recent years, much of that change could be the result of the spring weather conditions that may have impacted goose distribution and abundance in the state. Cold temperatures and April snowfall combined with a late ice-out reduced nesting success and effort, reducing the number of goslings. During the past 10 years, the Canada goose population?s average has ranged from 275,000 to 350,000.

?While that should not impact the population in the future, fewer young geese in the early fall usually makes goose hunting more difficult for hunters,? said Paul Telander, DNR wildlife section chief. ?The bottom line is our Canada goose population remains higher than we?d like it to be and we?ll continue to maximize hunting opportunities this fall.?

SAP warns China's slowdown is hurting software sales

FRANKFURT (Reuters) - German business software maker SAP AG trimmed its sales outlook for this year, warning that a slowdown in China was prompting companies across Asia to put investments on hold.

China's growth rate slowed to 7.5 percent in the second quarter, the ninth quarter in the last 10 that expansion has weakened, in a setback for companies betting on a continued boom in the world's second-biggest economy.

"The slowdown in China is now also impacting the tech industry," co-Chief Executive Jim Hagemann Snabe told journalists on Thursday.

That was having a knock-on effect to other companies in the region. Companies in Japan, Australia and New Zealand, particularly, have become more hesitant about investing, Snabe said.

SAP's biggest competitor, U.S.-based Oracle, last month blamed Asia and Latin America for its disappointing software sales and subscriptions.

The company cut its outlook for revenue growth from software and software-related services to at least 10 percent in 2013, excluding exchange-rate fluctuations, compared with a previous forecast for 11-13 percent growth.

In the second quarter, its software sales to customers in Asia-Pacific Japan dropped 10 percent at constant currencies, the second quarter in a row of double-digit declines, after rapid growth last year.

Including exchange-rate effects, sales were down 17 percent.

Snabe said he expected business in Asia-Pacific to recover, though it was hard to predict when. "We will continue to invest in Asia-Pacific," he said.

Shares in SAP were down 2 percent at 56.53 euros by 0913 GMT, in a flat market.

"It's only in the short-term that they may face difficulties, given the negative economic environment and the bottleneck in investments in the SAP client base," said Frank Niemann and Tobias Ortwein, analysts at Pierre Audoin Consultants.

"In the long term, it's a good story with more innovation likely to come."

SWITCH TO CLOUD

SAP, whose software helps companies manage supplies, human resources and customers relations, is reducing its reliance on traditional business software to become a major player in cloud computing.

The company reiterated that it expects 2013 operating profit to rise to 5.85-5.95 billion euros ($7.7-$7.8 billion) at constant currencies, from 5.21 billion in 2012 as it contains costs and banks on growing demand for cloud-based services.

SAP has launched a cloud-based version of its HANA tool, which helps companies analyze large quantities of data quickly and competes with Oracle's Exalytics product, as well as a new version of its Business Suite software running on top of HANA, which it started offering in mid-May.

It has spent billions of euros to buy Internet-based computing companies Ariba and SuccessFactors and battle IBM and Oracle as well as nimbler rivals like Salesforce.com Inc and Workday Inc for market share.

"We have about 30 million cloud users now, which gives us by far the largest subscriber base in the cloud," Snabe said, referring to the global market.

In the short term, customers' switch to cloud computing will hurt revenue growth because payments for cloud-based services are made in installments rather than up-front in full, but that effect is expected to even out in the long run.

In the three months through June, SAP's software and software-related service revenue grew 10 percent to 3.35 billion euros, the slowest growth rate in five quarters and a little below the 3.41 billion euros analysts had forecast.

Second-quarter operating profit was also up by 10 percent at constant currencies, at 1.22 billion euros, broadly in line with expectations.

E.J. Dionne: How GOP can solve immigration problem

WASHINGTON -- If you want to alleviate worries about the economic impact of immigration reform, increase the minimum wage.

If you want to reassure communities that bear the highest costs from large-scale immigration, revisit a proposal from 2006 by a senator named Hillary Clinton to help state and local governments cover some of the expense of providing health care and education to undocumented workers.

What do these suggestions have in common? They address legitimate concerns while issuing a challenge to Republicans who believe they can block reform and still win future elections -- as long as they expand their support among the white working class.

The catch for the GOP is that it doesn't seem eager to do anything concrete to earn the loyalty of such voters, many of whom stayed home in 2012 rather than vote for Mitt Romney.

Battling for a higher minimum wage would test the Republicans' newfound love for the salt of the earth. Are they willing to embrace an idea endorsed by seven in 10 Americans? Or do they retreat to Romney's rhetoric privileging "job creators" over workers?

Raising the minimum wage would also respond to a claim being put forward by opponents of immigration reform. "The last thing low-skilled native and immigrant workers already here should have to deal with is wage-depressing competition from newly arriving workers," wrote William Kristol and Rich Lowry in a joint editorial signaling an enhanced level of opposition on the right to the Senate immigration bill.

It's heartwarming to know that the editors of the Weekly Standard and National Review are now worried about depressed wages. In truth, granting immigrants who are here illegally basic labor rights would have a positive effect on wages for all workers. But if Kristol and Lowry are really worried about low-paid workers, let their next literary collaboration be an endorsement of a $9 or $10 hourly minimum wage.

Clinton's 2006 proposal likewise has the virtue of giving a substantive reply to questions regularly voiced by immigration foes.

The fiscal benefits of immigration reform to the federal government have been documented by the Congressional Budget Office, which estimated it would reduce the deficit by nearly $850 billion over two decades. But states and localities face additional public costs for schools and health care when they need to provide services for many immigrants who arrived illegally. The result can be higher property and sales taxes that hit working-class Americans hardest.

It makes sense for the federal government to share some of reform's fiscal bounty with governments lower down the chain. Such assistance would be a better use of the $46 billion the Senate added to the bill to further militarize our southern border.

The minimum wage and fiscal relief link to a larger imperative: With so many Republicans deciding that obstructing immigration reform is worth the political risks with Latino voters, this can no longer be seen as a normal legislative fight. Indeed, given the inclinations of House Republicans, there are no "normal" legislative fights anymore. Kristol and Lowry gave the game away: "In any case, House Republicans should make sure not to allow a conference with the Senate bill." In other words, down with the traditional ways of reaching compromise. Just say no, and no, and no again.

President Barack Obama should see nattering negative nabobism as an invitation: Immigration reform now has to be dealt with as part of a concerted effort to create an economy that grows because it's more just -- and is more just because it's growing.

Low- and middle-income workers took the biggest hit in the recession, as a report released recently by the National Employment Law Project showed. Real median hourly wages fell overall by 2.8 percent between 2009 and 2012, but by 5 percent or more in half of the top 10 low-wage occupations.

Immigration reform is easier to kill if it is disconnected from the concerns of such wage earners. It's easier to pass if it is seen as a necessary step toward an inclusive economy where the rights of native-born workers are strengthened because the rights of immigrants are protected -- and where the real wages of average workers are rising again.

As for Republicans who want to stake their future on the working class, by all means let's welcome a healthy competition. Let these voters ask the GOP: What will you do to raise our pay? And, by the way, new tax cuts for the rich are not an answer to the question.

Greenpeace and the Roundtable on Sustainable Palm Oil (RSPO), a body that sets criteria for greener palm oil production, are caught up in a row over the origin of fires that cast a pall over Sumatra, Singapore, and Malaysia last month.

The dispute started when media outlets, based on independent analysis of satellite data, identified several members of the RSPO as possible culprits in the fires in Riau Province. Greenpeace said the findings indicated that the RSPO is failing to hold its members accountable for burning. The activist group also criticized the RSPO for not expressly prohibiting deforestation and conversion of peatlands.

The RSPO responded by demanding that five member companies named in media reports submit maps of their concessions to prove that they were not involved in burning. Four of those five companies ? Sime Darby, Kuala Lumpur Kepong (KLK), Golden Agri Resources (GAR), and Tabung Haji Plantations ? complied with the demand. The fifth, PT Jatim Jaya Perkasa, missed the deadline, but filed the coordinates of its concessions on July 10.

The RSPO then handed the shape files showing the coordinates of the companies' oil palm concessions over to the World Resources Institute (WRI) and Khali Aziz Hamzah, a GIS expert at the Forest Research Institute Malaysia (FRIM), for analysis. The analysis, published July 11, revealed only a handful of hotspots in the plantation areas for Sime Darby, GAR, and Sime Darby. Jatim Jaya Perkasa had 74 hotspots, according to a statement issued by the RSPO on July 15.

Greenpeace however wasn't satisfied with those results, issuing a statement that those companies weren't the ones with the most fire hotspots and that RSPO's analysis glossed over the underlying issue: decades of forest clearance and peatlands drainage that set the stage for the most recent fires.

?The RSPO decided to focus its own investigations on just five of its members, but Greenpeace?s evidence points to a far wider problem for the sector, which neither the RSPO nor the companies implicated are owning up to,? said Bustar Maitar, head of the Indonesia Forest Campaign at Greenpeace International, in a statement issued July 11. ?Rather than claiming the innocence of members who?ve been reported in the media, the RSPO needs to address the real problem - years of peatland drainage and destruction which is labeled ?sustainable? under RSPO rules and has laid the foundation for these disastrous fires.?

?The RSPO was established nearly a decade ago in the wake of the 1997 forest fires, yet to date, it has failed to tackle its members? role in creating the conditions that lead to such disaster, nor has it held companies accountable for the impact of their operations. It's time for individual palm oil companies to step up and set the bar higher than the RSPO.?

But the RSPO didn't take that response lightly, issuing a statement that directly confronted Greenpeace on an issue that some Indonesian NGOs have been whispering about for weeks: Greenpeace's apparent lack of interest in focusing on hotspots detected within concessions belonging to Asia Pulp & Paper (APP) and its affiliates. APP is currently working to implement a "zero-deforestation" policy across the forest products giant's entire supply chain.

"The RSPO is of the opinion that Greenpeace has misplaced its objectivity in its analysis of the fires in Sumatra, Indonesia. It has been reported that the palm oil sector has contributed to 20% of the recent fires in Sumatra. Out of the many companies implicated, less than a handful of these companies are RSPO members ? which the RSPO views as serious and is fully committed to investigating and taking appropriate action if verified," said the RSPO in a statement posted July 15.

"However, at its peak there were 9000 hotspots identified and that 80% of the fires are occurring outside of palm oil plantations. The pulp and paper plantations have been identified as having significantly more fires than the oil palm plantations. This is a sector that Greenpeace has been actively involved in and we hope that Greenpeace would regain some perspective and start to apply the same rigor of watchfulness in this sector that the RSPO has in undertaking its own investigations."

The RSPO also criticized Greenpeace for using the media, rather than the body's complaint process, for alleging violations of standards.

"The RSPO has systems in place for stakeholders to seek recourse for any alleged violation against its code of conduct. On the other hand - Greenpeace has considerable resources, on the ground, which can provide credible evidence to make it easier for stakeholders to seek such recourse. It therefore would be highly constructive if Greenpeace and the RSPO can collaborate to address the issue at hand rather than using media sensationalism to address such a critical environmental dilemma."

Greenpeace subsequently responded saying the RSPO needs to be held accountable the role its member companies have played in creating conditions for fires.

"The RSPO cannot wash its hands of any responsibility for helping create the conditions in which the terrible fires last month took hold," Maitar told mongabay.com.

"The widespread drainage and clearance of peatland by plantation companies lays the conditions for the fires to turn into the disaster we all witnessed last month. Despite the RSPO?s public status as a champion of sustainability it still has not banned its members from deforesting or developing on peatland. Until it does, it implicitly gives a green stamp to dirty palm oil operations that set the stage for future fires."

The dispute between Greenpeace and RSPO risks shifting the focus away from other actors and issues associated with the haze. For example, while subsistence slash-and-burn farmers and industrial plantation developers have been mostly blamed for the recent fires, a new study by the World Agroforestry Centre suggests that a third category of land users ? 'mid-level entrepreneurs' ? may be in part responsible for the haze.

"These people acquire land under informal rules at village level, effectively sidestepping the Government land-use system," explained a statement from the World Agroforestry Centre. "They bring in their own labour to clear the land for oil palm, regardless of the land's formal government status and in the absence of any permits to do so."

On a more formal level, the response to the haze reveals that the Indonesian government has also failed to maintain, and make available, accurate data on concession ownership, complicating efforts to control fires and take action against those who started fires. And burning outside concession areas has effectively set the stage for the next round of concession expansion. It's unclear whether the government has the monitoring and enforcement systems in place to ensure that those who set the fires areas won't benefit from their illegal activities.

Finally while various parties are trying to assign blame for the haze, the fire risk in Riau has not diminished appreciably. WRI, which has been tracking fires closely, says "it is highly likely that severe burning seasons like the one we have seen over the past several weeks will be repeated."

"Forest fires in Indonesia are part of a long-standing, endemic problem?one that needs a coordinated and comprehensive solution if fire and haze risks are to be reduced."

Japan Beats U.S. To Take Gold At Softball World Cup

OKLAHOMA CITY (AP)?? Japan?s team experience again proved too much for a United States squad that just came together days before the eighth World Cup of Softball.

Yuki Hayashi went 2-for-4 with three RBIs and Japan beat the U.S. 6-3 on Sunday night to win the gold medal in the World Cup, ending the long reign of the Americans in the international event.

Yuka Ichiguchi tripled and had two RBIs for Japan, which beat the U.S. for the second time in as many days and extended its winning streak over the Americans to three games.

Japan also beat the U.S. in the gold-medal game of last year?s World Championships.

?My message to the team was that they?re better right now,? U.S. coach Ken Eriksen said of Japan. ?Right now, they are better. You saw the benefits of being able to train together for months and months and months. You saw the deficiencies of Team USA, with the inability to train for months and months and have five days to get together.

The six runs surrendered by the U.S. matched the second-most it had ever allowed in a major international tournament. Japan beat the U.S. 7-4 on Saturday to set that record.

The U.S. had won the last six World Cups since Japan took the inaugural event in 2005. That also was the last time the U.S. lost twice in the World Cup. The U.S. now is 42-6 all-time in the event.

Misato Kawano singled leading off in the first and scored on an infield single by Yukiyo Mine.

Michelle Moultrie walked and Lauren Gibson reached on an error in the bottom of the first and were in scoring position with one out, but Okamura struck out Amanda Chidester and coaxed a popup from Valerie Arioto to end the threat.

Japan blew the game open in the second against U.S. starter Jessica Moore (1-1). Natsuka Ono singled with one out and Nozomi Shimasaki followed with a bunt single. One out later, Moore intentionally walked Kawano to load the bases. Ichiguchi followed with a popup to short left field that hit the glove of the hard-charging Chidester but fell to the ground, allowing two runs to score.

Hayashi followed with a sharp single to right field and two more runs scored, making it 5-0.

?We made a bad play that let a bunch of runs in,? Eriksen said. ?That?s an easy play. We made the right pitch, we had the right kid at the plate, did the right things by walking who we did, then we drop an easy popup. If you don?t drop an easy popup, we may give up two (runs).?

Through an interpreter, Japan coach Reika Utsagi said her team was young and didn?t feel much pressure to win.

?Even though we knew they would be another pitcher today, our strategy was the same,? Utsagi said. ?It was to put the bat on the ball and make something happen, both yesterday and today. That?s what I think we did very well.?

Kourtney Salvarola singled and scored on a single by Moultrie in the bottom of the second and Gibson smacked a solo home run to right-center field in the third off Japan reliever Kana Nakano (2-0) to pull the U.S. within 5-2.

But Japan answered in the fifth. Ichiguchi?s shot to right field off reliever Sara Nevins eluded the diving Taylor Hoagland, resulting in a stand-up triple. Ichiguchi scored on a single by Hayashi.

?It felt like when we got a run or two, they?d come back and get a few runs,? Gibson said. ?They put the ball in play and execute when they have to.?

With two on and two out in the bottom of the fifth, Japan left fielder Sonoka Kuniyoshi misplayed a long fly ball by Arioto but recovered to make a basket catch at the wall. Arioto?s two-out double to right field in the seventh scored Chidester, who had singled, but Hoagland popped up to Nakano to end the game.

The U.S. left nine runners on base, including two each in the first, second, fifth and sixth innings.

?We had more opportunities that we didn?t drive in runners tonight in crucial situations,? Eriksen said.

The U.S. advanced to the gold-medal game with a 10-3, five-inning win over Puerto Rico. Amber Freeman hit a pair of two-run home runs, in the third to left-center field and in the fifth to right-center field.

On her second homer, she made an awkward turn at first base and injured her right ankle. She slowed and began walking slowly before being assisted around the bases the rest of the way by Puerto Rico shortstop Galis Lozada and third baseman Dayanira Diaz, resulting in a standing ovation from the crowd at ASA Hall of Fame Stadium.

With teammate Aleimalee Lopez translating, Lozada said after the game that she and Diaz assisted Freeman because it was the right thing to do.

?We only wanted to help her, because it was a home run and she deserved it,? Lozada said. ?I hope that if something like that happened to us, that they would have done the same thing in return.

?It?s a sport. You just have to respect every athlete.?

Freeman said she appreciated the help.

?That was very sweet of them,? she said. ?I?m very thankful, because I didn?t know if I could make it around the bases. My ankle hurt that bad. As soon as we got to home plate, I thanked them multiple times. It shows people the sportsmanship we have in this sport.?

Eriksen called the scene one of the highlights of his coaching career.

?I was fighting back tears over here, to tell you the truth,? he said. ?That?s just an incredible aspect of why these games need to be back in (the Olympics in) 2020. That?s sportsmanship that?s we?ve always had. . You have great representatives of every country.

?Watching something like that go on ? Wow!?

In the bronze-medal game, Australia beat Canada 4-3 in eight innings.

(AP) ? Celebrity chef Nigella Lawson and art collector Charles Saatchi said they intend to conclude a "swift and amicable" divorce by the end of the month, with neither receiving any financial compensation from the other.

The couple separated after a newspaper published photos last month of Saatchi grasping his wife's throat during an argument at a London restaurant.

A statement issued Monday on their behalf said neither would contest the divorce "and neither party will be making any financial claims against the other."

It said Lawson had hired powerhouse divorce lawyer Fiona Shackleton ? whose previous clients include Prince Charles and Paul McCartney ? while Saatchi was representing himself.

The couple's "decree nisi," or initial divorce decree, is due to be pronounced July 31.

Lawson and Saatchi married in 2003 and lived in London with Lawson's son and daughter from her marriage to journalist John Diamond, who died of cancer in 2001, and Saatchi's daughter from a previous marriage.

Saatchi, 70, was cautioned by police over the throat-grabbing episode, and shortly afterward announced that the couple was divorcing. He said he was disappointed Lawson had not spoken up to defend his reputation after the incident.

Lawson, 53, is a well-known TV presenter and chef whose cookbooks are best-sellers in Britain and the United States.

Saatchi, co-founder of the Saatchi & Saatchi ad agency, owns one of London's biggest private art galleries. He was the main patron of the Young British Artists movement of the 1990s, which made household names of artists including Damien Hirst and Tracey Emin.

Before You Consider That $350 Microsoft Tablet?

After nearly nine months of selling the Surface RT for $500, Microsoft is knocking the price down by $150.

Today, $350 will get you a 32 GB Surface RT tablet at any of the retailers who offer it, including Best Buy, Staples and the Microsoft Store. The 64 GB model, previously $600, is getting a similar price drop to $450.

Is the Surface RT a good deal now that it?s $150 cheaper? Probably not. Though it?s possible to be happy with a Surface RT, especially at the lower price, there are a few big reasons to stay away:

The Keyboard Case Will Still Cost You

If Microsoft?s own ads and slogan (?Click in and do more?) are any indication, Surface is incomplete without either a Touch Cover or Type Cover, which snap into the tablet and double as screen protectors. Neither are included with the $350 Surface, nor are they any cheaper now than they were before. You?ll still have to fork over another $100 for a black Touch Cover or $120 for a different color. If you prefer the Type Cover?s mechanical keys over the pressure-sensitive flat panel on the Touch Cover, you?ll have to pay an extra $130. In other words, you?ll still pay close to $500 for the whole package?not a great deal considering Microsoft was giving those covers away a month ago.

The App Situation Is Still So-So

Like all Windows RT tablets, the Surface RT cannot install any desktop software. That means no iTunes, no Photoshop, no Dreamweaver, no Chrome. Surface RT does include a free version of Microsoft Office 2013, as well as some other basic desktop apps like Calculator, Paint and Explorer, but for everything else, you must go through the Windows Store.

Microsoft has done an admirable job building the Windows Store from scratch, with about 100,000 apps available so far. But compared to Apple?s iPad, there are lots of gaps in the catalog, and some apps just aren?t as full-featured as they are on other platforms. Unless you?ve decided that you don?t need apps, you will run into frustrations.

Performance Needs to Be Better

The Surface RT runs on an Nvidia Tegra 3 processor, which is more than a year old, and the tablet?s performance has been routinely criticized as sluggish. Windows expert Paul Thurrott, who has far more experience using Windows RT and Surface RT than I do, sums it up in a recent blog post: ?Windows RT does everything slowly. Everything. The day-to-day experience is terrible.?

This is one of those cases where waiting for future hardware outweighs the cost savings of buying today. Chances are we?ll be seeing new Surface tablets soon, along with a slew of low-cost Windows 8 tablets later this year.

So Who?s It For?

There are always a few commenters in stories like this who insist that the Surface RT is a great product at any price. I?ll take the charitable view that these folks aren?t crazy, and I?ll allow that Surface RT makes sense in a handful of specific circumstances. Namely, if all you need in a tablet is a web browser and maybe a handful of basic apps like Netflix, and if full Office compatibility is essential for getting work done, then maybe the Surface RT handles all your needs for under $500.

Otherwise, richer 10-inch tablet experiences await in both Apple?s iPad 2 and Google?s Nexus 10, which both cost $400 and offer a better, more vibrant selection of apps. You can even tack on a Bluetooth keyboard case and use an Office alternative on these devices (I?m partial to OfficeSuite on Android and QuickOffice Pro on iPad) for some light work. Although the Surface RT?s price is lower now, that doesn?t mean you?ll be able to do more with it.

Ex-coach Brett Webber maintains innocence 18 years after sexual assault convictions

Brett Webber has had 18 years inside prison walls to consider his crimes.

In 1995, the former Bishop Kelley High School basketball coach was sent to prison on 25 felony counts of molesting and sexually assaulting seven students in his counseling office, classroom and home over a period of four years.

This week, the Pardon and Parole Board will review Webber's record to determine whether he'll move to the next part of the parole process for violent offenders - a personal appearance before the board in September. He's been turned down twice before.

If the fact that he remains unrepentant, refuses to admit guilt and has had no sex-offender treatment means staying in prison the rest of his life, then so be it, he says.

This was not his fault, he maintains.

"I'm not going to admit to something I didn't do," he said.

The lowest point

Webber's 1995 trial drew wide public interest. Webber's late father was a well-known TV personality in Tulsa.

A prosecutor asked one of the teen victims why he thought the charges were "a big deal."

"It is a big deal because he's a person that I trusted and he broke my trust with him by confronting me, putting his hand in my pants, inviting me to his house, telling me he's having dreams about me. That is a big deal," the teen said.

The victims had eerily similar stories that ended in different ways: Webber would approach each in a manner of "horseplay" or "wrestling." At some point, he attempted to peek down their boxers or slide his hand in their underwear, they said.

Some of the students immediately rebuffed these advances and told adults or older siblings shortly after, leading to Webber's firing from Bishop Kelley.

Others didn't tell, and the abuse escalated from there. At least two testified he forced them to engage in oral sodomy, and one of the allegations involved rape.

The first two teens to testify against Webber were Eagle Scouts with active parents who contacted school officials as soon as they heard their boys' stories.

Other victims who emerged were troubled teens with an unstable home life or history of drug use. Some went to prestigious universities while one ended up in prison.

The Tulsa World contacted several of the victims, now in their late 30s, from Webber's trial. None responded to interview requests. The World does not publish the names of sex-crime victims.

Brother David Poos was the principal at Bishop Kelley when the crimes occurred. Now principal of a Catholic high school in St. Louis, he recalled Webber's case as "the lowest point" in the school's history.

It started when a father of a student requested a meeting with Poos, saying: "You've got a teacher who can't keep his hands to himself." When Poos heard it was Webber, he was shocked.

"We thought, 'There's no way. This is an outstanding young man. He's an upstanding citizen,' " Poos said. "He was highly, highly regarded by everyone - the faculty, the staff, the administration. The kids loved him."

But the boys' stories had disturbing details, and a common pattern emerged.

Webber would get them alone, in a locker room, empty gym, his office or car. He would grab at their waistband and attempt to peek down their underwear, saying "I just want to see what you've got in there," according to trial records.

One of the teens, who had lived with Webber and his wife for a while because of family problems, testified that Webber raped him and performed oral sex on him on numerous occasions.

Webber was fired a few days after school officials learned of the allegations.

Life in prison

In July 1995, a 33-year-old Webber was sentenced to three life terms plus 385 years in prison.

The sentence eventually was reduced by the Court of Criminal Appeals to one life sentence for attempted rape plus 20 years for sodomy, molestation and sexual battery counts.

He's 51 now, but Webber's stance has not wavered. During a recent interview with the World at the Lexington Correctional Center, Webber maintained his innocence and said he was never alone with any of the alleged victims.

He engaged in horseplay and wedgies on occasion, nothing more, he said.

"Nobody has asked me for my opinion or my side of the story in 18 years. Nobody has ever attempted to," Webber said.

"When I was fired from Bishop Kelley, I requested a hearing with the Catholic Diocese. At that time, the (allegations) their investigators had found was based totally on horseplay (like) wedgies. And then once you get to the preliminary hearing, it gets a little more detailed and graphic, so it's building. And then finally in the trial - full-blown rape, sodomy, whatever. It all built."

The stories seemed to worsen and grow more consistent as the case moved toward jury trial, he said.

It was Webber's wife of nearly 27 years, Deana, who encouraged him to talk to the World for this story, he said.

"The only reason I agreed to do this (interview) was because my wife and I prayed about it and decided that we would like for our side to be heard. It never has been before. Everybody has always speculated. Nobody has ever come to us directly," he said.

Deana Webber lives in Oklahoma City now. She visits her husband in prison every Sunday and on holidays and they talk on the phone as often as possible, they said.

During the trial, the couple said Brett Webber could not possibly have been alone with any of the boys outside of school because the couple did everything together, every day - even showering.

Webber's father was former KJRH channel 2 news anchor Jerry Webber, who died of stomach cancer in 1998.

Fans of Jerry Webber and friends of the family wrote letters to the trial judge, Ned Turnbull, on Brett Webber's behalf, protesting his conviction.

"I certainly do not know the intimate details of the case, but I am absolutely convinced that the eyes are indeed the windows to the soul and the eyes I have seen belonging to Brett Webber are not the eyes of a monster," says one letter filed before the 1995 court sentencing.

Rivalries and faith

Brett Webber said he was the target of a conspiracy orchestrated initially by Poos, the former principal.

"He basically (conducted) a witch hunt to get me," Webber said. "Made phone calls to basically the whole basketball team ... It's the truth. He was very jealous of me. Everybody knew it. It wasn't a secret."

Why would Poos have been jealous?

"Because of my popularity," Webber said.

Webber was voted teacher of the year twice during the period in which the teens testified the abuse occurred. Webber also suggests religion could have been a factor.

"My wife and I are very strong, conservative Southern Baptists," he said, "and I was at a Catholic school (Bishop Kelley)."

His 18 years in prison have only strengthened his faith, he said.

"Basically, you realize that when everything around you has been stripped from you, that God is more than enough. I have seen over and over and over again how he has protected me and led me," he said.

Webber has declined to enter the prison's sex-offender treatment program, which would require him to admit guilt. He knows his chances of being paroled may be greatly diminished unless he agrees to treatment and expresses contrition.

"I'll accept it because I'm not going to admit to something I didn't do, just to get out," he said. "I don't know. Maybe that's stupid."

If the Parole Board were to vote in Webber's favor this time, he would be paroled only from his current life sentence to begin serving his remaining sentences - so Webber would likely have to wait many years for a chance to get out of prison.

He said he spends his time listening to Christian radio and baseball games, jogging and helping other inmates learn to read and earn their GEDs through Lexington's literacy program.

The victims

Poos says he is "flabbergasted" by Webber's contention there was jealousy or a conspiracy.

"That is the furthest thing from the truth," Poos said. "Yes, these young men were related in the sense that they were all students at Bishop Kelley, but there was no witch hunt. All of these young men came to me individually. I didn't go out after anyone. ... I didn't go to the basketball team. The only folks who were contacted were the victims who came to me."

Eric Stall, one of the prosecutors at Webber's trial, recalled him as "a manipulative individual," but said he didn't take joy in prosecuting him.

"I think a lot of people thought very highly of Jerry Webber," Stall said. "I hated for a family to go through this, but by the same token, I hated for a lot of victims' families to go through what they went through - and for the kids to go through what they went through."

Additional young men coming forward to report incidents as a case evolves is not unusual in molestation trials, he said.

Stall and Poos said they believe there might have been additional victims who never came forward.

Prosecutors asked one victim on the stand why he didn't tell anyone what happened to him when he was 13.

"I was embarrassed and ashamed," the teen testified. "I just didn't feel comfortable about what happened. And part of it was, I didn't know if anybody would believe me since he was so respected."



Deana Webber stands by her husband

In July 1995, the Tulsa World's coverage of the Brett Webber sentencing ended with these two paragraphs:

Deana Webber, outside the courtroom, said after nine years of marriage she will follow her husband, even if that means relocating to the town where he is staying in prison.

"We're inseparable," said Deana Webber, convinced of her husband's innocence. "I know the lies will eventually come out."

Today, Deana Webber lives and works in Oklahoma City - about a half-hour north of her husband's prison cell at the Lexington Correctional Center - and the Webbers are still married.

Their 27th anniversary is in August. For 18 of those 27 years, Brett Webber has been incarcerated, convicted of molesting teen boys during the early '90s.

"People tried to explain to us that, 'You'll never walk out again if you go through with the trial,' " said Deana Webber, now 47. "At the same time, we knew what we knew. We believed what we believed."

Deana Webber said her husband's conviction was a shock.

"We never dreamed first of all that he would be convicted. And then after he was convicted, we just knew we would straighten it all out after a year or so."

Still, Deana Webber said she will stand by her husband "even if you tell me that it's until death."

"You should see my closet," she added. "From top to bottom, it is filled with letters. That's how close we are. We write every day."

Deana Webber played basketball at Jenks High School and for one season (1984-85) at Oral Roberts University. She then was known by her maiden name - Deana Calvert.

Now 47, Deana Webber visits her husband every Sunday and on holidays. They have no children.

The six-hour visitation period "goes by real fast," Deana Webber says. The Webbers are allowed to be outside, confined to "a tiny little yard that you can walk around," she says. Otherwise, their time together is spent in a room that resembles a school cafeteria.

The Webbers speak by telephone nearly every day, Deana Webber says, and the cost is "almost $3 a call for 15 minutes."

She pays additional money each month so her husband may purchase food in the prison canteen.

"It is extremely expensive to have somebody in prison," she said.

Brett Webber maintains his innocence of the crimes for which he was convicted, and Deana Webber is unwavering in her belief that he did not commit any crimes.

"It's not a blind belief, though. It's an I-went-through-it belief," she said.

"We lived an up-and-down roller coaster for years. It is very hard. It is miserable in this situation. But at some point, you come to terms and you come to peace with it or you won't survive."

During her husband's trial, Deana Webber testified that some of the alleged incidents could not have happened because she and Brett would have been together at that time.

"They said it was too good to be true, but you have to understand that to see Brett - because he was so busy - I went to everything," Deana Webber said last week.

"We did camps together. I went to practices. We were married nine years before this happened, and I had never gone to the grocery store or got my hair cut without him. Ever."

She said she's hopeful that he will one day be released from prison, despite the life sentence he's serving.

"I live just accepting everything, but I truly believe that one day this will be over. Now, do I think it's going to happen through parole? No. ... We have a faith and a belief that God has told us that we're going to get out."

Anthony Pettis replaces injured T.J. Grant, setting up anticipated rematch with Benson Henderson

Anthony Pettis was supposed to open August fighting Jose Aldo for the UFC featherweight title. Instead, after two injuries, Pettis will instead close the month rematching Benson Henderson at UFC 164 on Aug. 31 in Milwaukee for the UFC lightweight belt.

Pettis defeated Henderson in the final event in World Extreme Cagefighting history, lifting that organization's belt from Henderson by pulling off the now-legendary "Showtime kick" in the waning moments of a close fight. Pettis leaped up against the cage, pushed off and blasted a surprise Henderson in the head with a kick.

That move, one of the most spectacular in modern mixed martial arts history, lifted Pettis to the WEC title.

Henderson later went on to win the UFC lightweight belt and was supposed to defend it against T.J. Grant at UFC 164. But, according to UFC president Dana White, Grant suffered an injury and had to withdraw.

Grant tweeted that he suffered a concussion while practicing jiu-jitsu and had to withdraw. He also tweeted that it was not a conspiracy by the UFC to get Pettis onto the card.

But that opened the door for the Henderson-Pettis rematch. Pettis had injured a knee that forced him to pull out of his planned Aug. 3 featherweight title fight with Aldo in Brazil. He was replaced on that card by "The Korean Zombie," Chan Sung Jung.

MMA Junkie first reported Grant's injury and the coach of Pettis as his replacement.

Pettis coach Duke Roufus said Pettis' knee "is feeling great after rehab."

White was ecstatic to be able to make the bout and said he thinks the UFC is set up for a memorable finish to 2013.

"If all of these fights we have set hold up and no one else gets hurt, this is going to be the baddest string of fights we've ever done in a six-month period," White said. "Without question, this will be the best second-half of a year in UFC history."

White noted that the string began last week with Chris Weidman's stunning upset win over middleweight champion Anderson Silva at UFC 162 in Las Vegas.

The rest of the 2013 pay-per-view schedule, according to White, is:

White spent much of his day Friday in Los Angeles negotiating with Silva about a rematch with Weidman that he hopes to put on UFC 168. Silva has commitments to sponsors he's already made, though, that may make it impossible for him to fight as soon as December.

"We'd love to have him on that New Year's Eve card in Vegas," White said. "That would be sick. We're working on that, but all that stuff Anderson has going on is why the Super Bowl card is still a possibility."

Pettis could be reached for comment on Friday, but Roufus was with Pettis when he was offered the fight with Henderson. He was thrilled, not only for the title opportunity but for the chance to do it in Milwaukee, his hometown.

"Anthony and I received the news together here," Roufus said. "He can't wait to get the UFC championship. Ben is a great fighter, but Anthony is a special fighter who will beat Ben again."

White said one of the reasons he likes Pettis so much is that he is willing to fight anyone at any time. He said Pettis had no concern about having started to get ready to fight at featherweight and then having to go up and fight at lightweight.

Pettis, he said, just loves to compete in big fights.

"What I love about this guy is he doesn't give a [expletive] about stupid [expletive] like whether it's at 145 or 155 or where it is or when it is or any of that," White said. "He has the attitude, 'I'm the best. I'm going to win. I don't care when or where. Let's do it.' Those are the kind of guys I love."

White also said he is in talks to re-sign heavyweight Roy Nelson, whose contract expired in June after a loss to Stipe Miocic at UFC 161 in Winnipeg. White said if he re-signs Nelson in time, he plans to pair him with Daniel Cormier at UFC 166 on the Velasquez-dos Santos III undercard.

Nelson and Cormier have had a feud on social media and have been eager to fight. Cormier is also Velasquez's training partner, close friend and wrestling coach.

A mother pygmy sperm whale died and her calf was euthanized after they washed ashore Tuesday morning onto a Jupiter Island beach.

Authorities spotted the mother and her calf at about 8 a.m. while they patrolled the shore about five miles north of the Blowing Rocks Preserve.

Officials from the Florida Fish and Wildlife Conservation Commission, Loggerhead Marinelife Center in Juno Beach and Marine Animal Rescue Society responded and evaluated the whales.

John Cassady, an FWC biologist, said the approximately 9-foot, 800-pound mother died after she landed on shore.

Loggerhead veterinarians decided to euthanized the 3-foot, 100-pound calf, saying it could not survive on its own.

"The rehab potential for these animals is very small," Cassady said. "There really isn't much we can do for them once they do come up to the beach like this, especially with a calf that small."

Officials and volunteers used a winch on the back of an FWC pickup to drag the mother's carcass from the beach. They then lifted the whale and laid it on the truck's flatbed.

Steve Stanford was one of several volunteers who helped officials move the mother's carcass from the water.

Stanford, 31, of Palm City, said he and his 27-year-old brother saw the whales stranded while they were on break from painting a house.

It was the first time they saw whales up close, he said.

"That's why we were so interested," Stanford said. "It's different. You don't see (the whales) very often."

Officials then took the carcasses to the Gumbo Limbo Nature Center in Boca Raton for a necrospy.

Barbara Brunnick, research director for the Taras Oceanographic Foundation, performed the procedure and found the whales showed "no obvious signs" of how they died.

Brunnick said the mother may had been exposed to harmful toxins in the water or could not dive deep enough underwater for food.

Experts say 90 percent of pygmy sperm whales stranded on shore suffer from cardiomyopathy, a form of heart disease.

But when Brunnick conducted Tuesday's necropsy on the mother, she said "there were no obvious problems with the heart."

The whales' internal organs have since been sent to Miami scientists for testing.

"If there was something internal, they'll figure that out in the lab," Brunnick said.

Tuesday's incident was the second pygmy sperm whale beach stranding in about a month.

On June 10, a 10-foot-long, 1,500-pound mother whale and her female calf landed on shore north of the Jupiter Reef Club. The mother died after she washed ashore, and veterinarians euthanized her 6-foot-long, 400-pound calf.

Whales can land on shore for a variety of reasons, experts say. They could lose their ability to navigate, separate from other whales or suffer from exhaustion.
